Welcome to The Wandering Sanctuary. These Terms of Service ("Terms") govern your use of our website at www.thewanderingsanctuary.com (the "Site"), our booking platform powered by Wheelbase, and our mobile Airstream and recreational vehicle rental services (collectively, the "Services").

By accessing the Site, requesting a quote, making a booking, or otherwise using our Services, you agree to be bound by these Terms, our Privacy Policy, our Cancellation Policy, and the Rules of the Road that apply to your stay. If you do not agree, please do not use the Services.

1. ABOUT US

The Wandering Sanctuary is a Texas-based luxury mobile hospitality business operating from Driftwood, Texas. We own, manage, and consign Airstream travel trailers and similar recreational vehicles ("Units") and provide stationary delivery rentals throughout the Texas Hill Country and surrounding regions. We may, in the future, also offer tow rentals to qualified drivers. References in these Terms to "Company," "we," "us," or "our" refer to The Wandering Sanctuary.

References to "you" or "your" refer to the individual using the Site or booking the Services.

2. ELIGIBILITY

2.1 Age. The Site and Services are intended for adults. To make a booking, you must be at least twenty-five (25) years of age. Drivers ages twenty-one (21) through twenty-four (24) may qualify for tow rentals on a case-by-case basis with our prior written consent and applicable surcharges.

2.2 Capacity to Contract. By using the Services, you represent that you have the legal capacity to enter into a binding contract under Texas law and that all information you provide is accurate, current, and complete.

2.3 Identification. We may require you to provide a valid, non-temporary, government-issued photo ID matching the name on the reservation and the payment method on file. We may decline service if identity cannot be verified.

3. BOOKINGS AND PAYMENTS

3.1 Booking Channels. You may book directly through our Wheelbase-powered booking platform or through third-party platforms including Outdoorsy, RVshare, Airbnb, and Vrbo. The booking channel determines which terms govern certain aspects of your reservation:


 - Direct bookings are governed by these Terms, our Cancellation Policy, our Rules of the Road, and the Guest Rental Agreement you sign before check-in or pickup.

 - Third-party platform bookings are governed by the platform's terms and policies in addition to these Terms. In the event of conflict between a platform term and these Terms, the more protective term shall govern to the extent permitted by the platform.


3.2 Booking Confirmation. A booking is not confirmed until you receive a written confirmation from us (or from the third-party platform) and your initial payment has been processed. We reserve the right to decline any booking request in our sole discretion.

3.3 Payment Schedule.

- A non-refundable booking deposit of fifty percent (50%) of the total is due at the time of booking.

  - The remaining balance is due thirty (30) days prior to check-in or pickup.

  - For bookings made fewer than thirty (30) days before check-in or pickup, the full total is due at the time of booking.

3.4 Damage Deposit. A refundable damage deposit will be either charged or pre-authorized on your payment method prior to or upon check-in or pickup. The deposit, less any amounts retained under our Guest Rental Agreement, will be released or refunded to you within fourteen (14) days after check-out or return.

3.5 Texas Sales and Use Tax. Charges under our Services are subject to Texas sales and use tax at the then-current state and local combined rate, which we (or the booking platform) collect and remit to the appropriate authorities. Our Services are not subject to Texas state or local hotel occupancy tax.

3.6 Authorization to Charge. By providing a payment method, you authorize us to charge that method for all amounts due under your booking, including the booking deposit, balance, damage deposit, taxes, and any post-stay charges authorized under the Guest Rental Agreement (such as damage costs, missing items, excessive cleaning, late return fees, mileage overage, or violations of the Rules of the Road).

3.7 Failed Payments. If a payment method is declined or reversed, we may cancel the booking, suspend the Services, or pursue collection. You are responsible for any fees, charges, or costs incurred as a result of failed payments.

4. CANCELLATIONS AND RESCHEDULING

4.1 Cancellation Policy. Cancellation refunds are governed by our Cancellation Policy, available at [LINK TO POLICY]. The policy that applies to your booking depends on whether you booked directly with us or through a third-party platform.

4.2 Rescheduling. We accommodate one-time courtesy rescheduling where reasonable. Requests must be made in writing and are subject to availability. Detailed rescheduling terms are set forth in the Cancellation Policy.

4.3 Cancellations By Us. If we must cancel due to mechanical issues, unsafe site conditions, force majeure, or other circumstances beyond our reasonable control, we will work in good faith to substitute another Unit, reschedule, or refund amounts paid. Our liability is limited to amounts you have paid us; we do not reimburse third-party costs such as flights, alternate lodging, or lost time.

5. THE GUEST RENTAL AGREEMENT

5.1 Required Agreement. Before delivery, check-in, or pickup, all guests must sign our Guest Rental Agreement, which contains detailed terms governing the rental, including assumption of risk, release and indemnification provisions, and damage charge authorizations. The Guest Rental Agreement is incorporated into these Terms by reference.

5.2 Rules of the Road. All guests must read and agree to our Rules of the Road before check-in. The Rules of the Road include important safety, occupancy, smoking, pet, fire, and care-of-Unit requirements, and are incorporated into these Terms by reference.

5.3 Stationary vs. Tow Rentals. Most rentals are stationary deliveries: we deliver, level, set up, and retrieve the Unit, and you do not move it. If you book a tow rental (when offered), you must qualify as a Verified Driver under our Guest Rental Agreement and use a tow vehicle that meets all requirements specified therein.

6. ACCEPTABLE USE OF THE SITE

When using the Site, you agree not to:

  (a) violate any applicable law, regulation, or third-party right;

  (b) provide false, misleading, or fraudulent information;

  (c) attempt to circumvent or disable any security measure or access control;

  (d) introduce viruses, malware, or other harmful code;

  (e) scrape, harvest, or otherwise extract data from the Site for commercial purposes without our written permission;

  (f) impersonate another person or entity;

  (g) interfere with the proper functioning of the Site;

  (h) use the Site or Services for any unlawful, harmful, harassing, or abusive purpose; or

  (i) use the Site to make speculative, false, or fraudulent booking requests.

We reserve the right to suspend or terminate your access to

the Site for any violation of this Section.

7. INTELLECTUAL PROPERTY

7.1 Our Content. All content on the Site, including text, images, photographs, videos, logos, branding ("soft sheets, wild places," "The Wandering Sanctuary," our visual identity), graphics, and software, is owned by The Wandering Sanctuary or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

7.2 Limited License. We grant you a limited, non-exclusive, non-transferable, revocable license to access and view Site content for your personal, non-commercial use in connection with making and managing bookings.

7.3 Restrictions. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any Site content without our prior written permission, except that you may print or save individual pages for your personal records related to a booking.

7.4 Trademarks. "The Wandering Sanctuary" and "soft sheets, wild places" are trademarks of The Wandering Sanctuary. Unauthorized use is prohibited.

7.5 User Content. By submitting reviews, photos, comments, or other content to the Site or to a public review platform that identifies The Wandering Sanctuary, you grant us a worldwide,

non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, and distribute that content for our marketing and operational purposes, subject to revocation upon written request.

8. PRIVACY

Your privacy matters to us. Our collection, use, and disclosure of personal information is described in our Privacy Policy, available at https://www.thewanderingsanctuary.com/privacy, which is incorporated into these Terms by reference. By using the Services, you consent to the practices described in the Privacy Policy.

9. THIRD-PARTY PLATFORMS, LINKS, AND SERVICES

9.1 Booking Platforms. We use third-party platforms including Wheelbase (our direct booking provider), Outdoorsy, RVshare, Airbnb, and Vrbo to facilitate bookings. Your use of those platforms is governed by their respective terms of service and privacy policies. We are not responsible for the availability, content, security, or practices of any third-party platform.

9.2 Insurance and Protection Programs. Where bookings include third-party platform protection packages (such as Outdoorsy's Protection Package or RVshare's Protection Plan), the platform's coverage terms govern those programs. We do not underwrite or guarantee any platform protection coverage.

9.3 External Links. The Site may contain links to third-party websites. Those websites are not under our control, and we are not responsible for their content, terms, or privacy practices.

9.4 Payment Processing. Payments are processed by third-party processors. We do not store complete payment card numbers and are not liable for the practices of any payment processor beyond what is required by applicable law.

10. DISCLAIMERS

10.1 SITE PROVIDED "AS IS." THE SITE AND THE INFORMATION ON THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10.2 ACCURACY OF INFORMATION. We strive to keep Site information accurate and current, but we do not warrant that all listings, photos, descriptions, pricing, or availability information is accurate or complete at any given moment. Pricing and availability are confirmed only at the time of booking confirmation.

10.3 NO WARRANTY OF FITNESS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

10.4 EXPERIENCE-BASED DISCLAIMER. The rental experience involves inherent risks, including but not limited to those described in our Guest Rental Agreement and Rules of the Road. You assume all such risks as detailed in those documents.

11. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, IN NO EVENT SHALL THE WANDERING SANCTUARY OR ITS OWNERS, MEMBERS, EMPLOYEES, INDEPENDENT CONTRACTORS, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR SERVICES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

This limitation does not apply to:

  (a) claims arising from our gross negligence, intentional misconduct, or fraud;

  (b) liability that cannot be limited under Texas law; or

  (c) the specific indemnity, release, and damage authorization provisions in the Guest Rental Agreement, which govern claims related to the rental itself.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless The Wandering Sanctuary and its owners, members, employees, contractors, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  (a) your breach of these Terms;

  (b) your violation of any applicable law or third-party right;

  (c) your misuse of the Site or Services; and

  (d) any false or misleading information you provide.

This indemnification is in addition to the more specific indemnification provisions of the Guest Rental Agreement, which govern claims arising from the rental itself.

13. GOVERNING LAW AND DISPUTE RESOLUTION

13.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-laws principles.

13.2 Venue. Any action arising out of or relating to these Terms or your use of the Site or Services shall be brought exclusively in the state or federal courts located in Hays County or Travis County, Texas, and you consent to the personal jurisdiction of such courts.

13.3 Mediation Before Litigation. Before commencing litigation, the parties shall attempt in good faith to resolve any dispute through informal negotiation, and if unsuccessful, through non-binding mediation in Austin, Texas, with a mutually agreed mediator. The cost of mediation shall be shared equally.

13.4 Attorneys' Fees. In any action to enforce these Terms, the prevailing party shall be entitled to recover its reasonable attorneys' fees and costs.

13.5 Jury Trial Waiver. To the fullest extent permitted by Texas law, the parties waive the right to trial by jury in any action arising out of or relating to these Terms.

13.6 Time Limit on Claims. Any claim arising out of or related to these Terms or your use of the Site or Services must be brought within one (1) year of the event giving rise to the claim, or such claim is permanently barred.

14. CHANGES TO THESE TERMS

We may modify these Terms from time to time. The most current version will be posted on the Site with the "Last Updated" date. Material changes will be communicated by email to active guests with confirmed bookings. Your continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms. Bookings already confirmed will be governed by the Terms in effect at the time of booking, except for provisions related to use of the Site.

15. TERMINATION

15.1 By You. You may stop using the Site at any time. Active bookings remain subject to the Cancellation Policy and Guest Rental Agreement.

15.2 By Us. We may suspend or terminate your access to the Site or Services at any time, with or without notice, for violation of these Terms, fraud, abuse, or other conduct that in our reasonable judgment harms our business, our guests, or the integrity of our operations.

15.3 Survival. The following Sections survive termination: 3 (payment obligations for prior bookings), 5, 7, 8, 10, 11, 12, 13, 14, 15.3, and 16.

16. GENERAL PROVISIONS

16.1 Entire Agreement. These Terms, together with the Privacy Policy, the Cancellation Policy, the Rules of the Road, the Guest Rental Agreement, and any platform-specific terms, constitute the entire agreement between you and us regarding your use of the Site and Services and supersede all prior communications.

16.2 Document Hierarchy. In the event of a conflict between documents, the following order of precedence applies, except where a more specific document explicitly governs:

  (a) the Guest Rental Agreement (for matters relating to a specific rental);

  (b) the booking platform's terms (for platform-mediated bookings);

  (c) these Terms of Service;

  (d) the Cancellation Policy;

  (e) the Rules of the Road;

  (f) the Privacy Policy.

16.3 Severability. If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be reformed to the minimum extent necessary to make it enforceable while preserving the parties' intent.

16.4 No Waiver. Our failure to enforce any provision shall not be deemed a waiver of that or any other provision.

16.5 Assignment. You may not assign these Terms or any rights under them. We may assign these Terms in connection with a sale, merger, reorganization, or other transfer of our business.

16.6 No Agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and us beyond the limited rental relationship explicitly described in the Guest Rental Agreement.

16.7 Force Majeure. We shall not be liable for delays or failures caused by events beyond our reasonable control, including acts of God, severe weather, natural disasters, pandemics, governmental orders, utility outages, or other extraordinary events.

16.8 Electronic Communications. By using the Site or making a booking, you consent to receive communications from us electronically, including by email, text, and platform message, and you agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing.

16.9 Headings. Section headings are for convenience only and do not affect interpretation.

By using the Site, requesting a quote, making a booking, or otherwise using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service, our Privacy Policy, our Cancellation Policy, our Rules of the Road, and (upon booking) our Guest Rental Agreement.
